The Matrimonial Classifieds – Terms and Conditions

"The Matrimonial Classifieds" (referred to in these Terms as "The Classifieds," "the Platform," "we," "us," or "our") is a self-directed matrimonial classifieds platform having its website at www.matrimonialclassifieds.com and owned and operated by ARMEIS Advisory Pvt Ltd. These Terms and Conditions govern your access to and use of the Platform, including membership services, profile listings, communications, promotional features, and related offerings. All parties who use the services of the Platform have been referred to as User / Member.

1. Acceptance of Terms

By accessing or using the Platform, creating a profile, purchasing a membership, or interacting with The Classifieds in any manner, you agree to these Terms & Conditions and also the Platform's Privacy Policy available at Privacy Policy and the Platform's Policy on Child Safety & Standards available at Child Safety Standards.

If you do not agree, you must discontinue use of the Platform.

The Company may update these Terms from time to time. Continued use of the Platform following any update constitutes acceptance of the revised Terms.

2. Eligibility

You may use the Platform only if you are legally eligible to marry under the laws applicable to you, have the legal capacity to enter into these Terms, and provide complete, accurate and up-to-date information.

We strictly prohibit any form of Child Sexual Abuse and Exploitation (CSAE) and/or posting of any kind of Child Sexual Abuse Material (CSAM) on our Platform. We are committed to maintaining a safe environment for our users and taking swift action against any activity that threatens the safety and well-being of children. By registering for an account or becoming a member with us, each user represents and confirms that they are at least 18 years old. We do not knowingly permit minors to create accounts or use our platform, and any account found to have been created by or on behalf of a person under the age of 18 will be suspended or permanently removed without notice.

You may not use the Platform if you are impersonating another person, using the Platform for unlawful or non-matrimonial purposes, or otherwise violating applicable law, regulation, the Platform's Terms & Conditions or Privacy Policy or Policy on Child Safety & Standards.

If you register on behalf of another individual, you represent that you are authorized to do so and that the individual has consented to these Terms and agrees to be bound by these Terms.

3. Nature of the Platform

The Classifieds operates as a self-directed matrimonial classifieds platform. Members are responsible for creating profiles, browsing listings, initiating communication with other Members, and making independent decisions regarding interactions and relationships or matrimonial arrangements.

Information provided by Members is self-reported and is not independently verified, authenticated or endorsed by the Company.

The Platform does not provide:

• curated or personalized matchmaking;
• background verification, identity checks or due diligence on Members;
• legal, financial, psychological, medical, or immigration advice; or
• any guarantee regarding compatibility, engagement, responses, or matrimonial outcomes.

Any concierge or support services provided by the Platform are advisory in nature and do not alter the self-directed nature of the Platform and it also does not create any obligation on the Platform to arrange, evaluate, or guarantee desired matrimonial outcomes.

Members acknowledge and agree that they are solely responsible for exercising independent judgment and should not rely exclusively on information provided by other Members through the Platform while making personal, financial, legal, or matrimonial decisions. Members may independently verify any information they consider relevant.

4. Member/User Responsibilities

By using the Platform, Users agree to:

• provide accurate, complete, truthful and up-to-date information;
• maintain the confidentiality of your account credentials and inform the Platform in case of any unauthorized access or suspected misuse;
• interact respectfully with other Members;
• independently assess, verify and evaluate information shared by other Members; and
• comply with applicable laws, regulations, the Platform's Terms & Conditions, Privacy Policy and Policy on Child Safety & Standards.

Users acknowledge and agree that the Platform does not and cannot guarantee any specific outcome, including but not limited to successful introductions, responses from other Users, compatibility, engagement, marriage, relationship success, or any other matrimonial result. Members understand that matrimonial decisions and outcomes depend on various factors beyond the Company's control, including individual preferences, choices, communications, and circumstances of Members.

Members acknowledge and agree that they are solely responsible for their communications, meetings, and decisions made through or outside the Platform. The Platform strongly encourages Members to exercise discretion and appropriate personal safety precautions when interacting with other Members and third-parties. Members should take appropriate steps to protect their personal information, safety, and well-being throughout their interactions.

5. Prohibited Conduct

Users agree not to:

• create false, misleading, or duplicate profiles;
• harass, threaten, exploit, or abuse other Members;
• use the Platform for commercial solicitation, scams, or financial exploitation;
• misuse confidential or personal information of other Members;
• copy, scrape, or extract Platform data in any form or manner;
• interfere with Platform's security or functionality;
• use the Platform for unlawful, deceptive, or non-matrimonial purposes; or
• violate applicable laws or regulations or the Platform's Terms & Conditions or Privacy Policy or Policy on Child Safety & Standards in any form or manner.

Members understand and acknowledge that the Company may without notice restrict, suspend, or terminate access where conduct violates these Terms or may compromise Member safety or Platform integrity.

6. Memberships and Payments

Membership tiers, pricing, durations, and included features are described on the Platform at the time of purchase.

Members agree and acknowledge that:

• membership fees are payable in advance and must be paid in full before access to applicable membership features is provided;
• all membership fees paid by Members are non-refundable;
• memberships are personal to the registered Member and are non-transferable;
• applicable taxes, duties, or government charges may be added to the membership fees as required by law; and
• certain memberships may renew automatically unless cancelled prior to renewal.

Members are responsible for maintaining valid payment information and for any bank charges, currency conversion fees, or applicable taxes.

7. Refund Policy

Members acknowledge and agree that membership fees are charged for access to the Platform, its infrastructure, member environment, visibility tools, and related services, and not for guaranteed matrimonial outcomes, introductions, engagement, or relationship success. Members further acknowledge and agree that the Company does not and cannot guarantee any specific result from the use of the Platform.

Members acknowledge and agree that all membership fees, subscription payments, promotional purchases, and related charges are final and non-refundable once processed.

Members acknowledge and agree that no refunds, credits, prorated reimbursements, or extensions will be issued for:

• unused membership periods;
• lack of responses, engagement, or introductions;
• dissatisfaction with the Platform or Member experience;
• unsuccessful matrimonial outcomes or inability to find a suitable match;
• voluntary discontinuation;
• suspension or termination resulting from violation of applicable laws or regulations or the Platform's Terms & Conditions or Privacy Policy or Policy on Child Safety & Standards in any form or manner; or
• changes in personal circumstances, preferences, location, or relationship status.

Visibility enhancements, featured placements, and promotional services are time-bound promotional tools intended to improve profile visibility or exposure. Members acknowledge and agree that such tools do not guarantee visibility levels, engagement, compatibility, or desired matrimonial outcomes.

The Platform may, at its sole discretion, offer a credit, extension, or partial refund in exceptional circumstances, including prolonged technical interruptions directly attributable to the Platform. Members acknowledge and agree that any such action shall be considered on a case-by-case basis and shall not create an obligation on the Platform to provide similar remedies in other circumstances.

Members agree to contact the Platform regarding billing or other concerns and provide the Platform with a reasonable opportunity to address such concerns before initiating chargebacks or payment disputes.

8. Confidentiality and Privacy

Profiles and communications may contain sensitive personal and other information. Members agree to use information obtained through the Platform solely for legitimate matrimonial evaluation and communication purposes.

Members agree to not publish, distribute, screenshot, misuse, or disclose another Member's information obtained through the Platform without written consent from the concerned Member.

The Company's collection, storage, use, disclosure and processing of personal and other information is governed by the applicable laws or regulations or the Platform's Terms & Conditions or Privacy Policy or Policy on Child Safety & Standards in any form or manner.

Members acknowledge that they are responsible for maintaining confidentiality and exercising appropriate care when sharing personal information with other Members through or outside the Platform.

9. Intellectual Property

Members agree that all Platform content including, but not limited to branding, software, designs, logos, trademarks, copyrights, graphics, interfaces, lay-out, colour combinations, and related content and the intellectual property and other common law and other rights to such content are owned by the Platform or its licensors and are protected by applicable laws.

Subject to the Members' compliance with applicable laws or regulations or the Platform's Terms & Conditions or Privacy Policy or Policy on Child Safety & Standards, Members receive a limited, revocable, non-transferable license to access and use the Platform for legitimate personal matrimonial purposes only.

Members retain ownership of content they submit or make available through the Platform. However, by submitting such content, Members agree to grant the Platform a non-exclusive and royalty-free license to use such content for operating, improving, and promoting the Platform and its services.

Members hereby confirm that they have all necessary rights, permissions, and authority to submit any content that they provide to the Platform and that such content does not infringe the rights of any third party or violate applicable laws or regulations or the Platform's Terms & Conditions or Privacy Policy or Policy on Child Safety & Standards.

The license granted to the Platform will continue for as long as reasonably necessary to fulfill the purposes described above, including after termination of the concerned Members' account where required for legitimate business, legal, or operational purposes.

10. Disclaimers

While the Platform seeks to maintain a reliable and secure member experience, the Platform is provided on an "as available" and "as is" basis.

Members agree and understand that the Platform does not guarantee:

• uninterrupted or error-free access;
• the accuracy of Member-provided information;
• member conduct or intentions;
• compatibility or relationship success; or
• any specific outcome arising from use of the Platform.

Members are encouraged to exercise independent judgment and verification before relying on information shared through the Platform.

Members acknowledge that the Platform does not control, supervise, or assume responsibility for the conduct, statements, decisions, or actions of Members.

Members agree to exercise independent judgment, conduct appropriate verification, and take reasonable precautions before relying on information shared through the Platform or engaging with other Members and the Members agree to hold harmless the Platform and its representatives and service providers from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to the transactions with other Members.

11. Limitation of Liability

Members agree that to the maximum extent permitted by law, the Platform shall not be liable for indirect, incidental, consequential, emotional, reputational, special, or punitive damages arising from use of the Platform by Members.

The Platform's aggregate liability arising from these Terms or the Platform shall not exceed the total amount paid by any Member to the Platform during the twelve months preceding the event giving rise to the claim.

Members acknowledge that the Platform is a self-directed matrimonial classifieds service and that the Company does not guarantee introductions, compatibility, relationship success, marriage, or any specific outcome.

Nothing in these Terms excludes liability that cannot legally be excluded or limited under applicable law.

12. Indemnification

Members agree to indemnify and hold harmless the Platform, its affiliates, officers, employees, and representatives from claims, liabilities, damages, costs, or expenses arising from:

• Members' use of the Platform;
• Members' violation of these Terms;
• Members' interactions with other Members; or
• Members' violation of applicable law or regulations or understanding or third-party rights;
• Members' act, omission, negligence, misconduct, or unauthorized use of the Platform by Members.

Members agree that their obligation to indemnify the Platform will continue even after termination of account or membership.

13. Suspension and Termination

Members may terminate their membership or account at any time by contacting the Company. Any such termination shall remain subject to the Member's continued compliance with these Terms and all applicable laws and regulations, including the Platform's Terms & Conditions, Privacy Policy, and Child Safety Standards & Policy.

Members agree that the Platform may suspend or terminate access without notice where:

• these Terms are violated;
• false or misleading information is provided;
• unlawful or harmful conduct is suspected; or
• continued access may compromise Member safety or Platform integrity; or
• violation of applicable laws or regulations or the Platform's Terms & Conditions or Privacy Policy or Policy on Child Safety & Standards.

Upon suspension or termination, access to the Platform, account, profile, membership benefits, and related features may be revoked immediately.

14. Governing Law and Dispute Resolution

Members agree that any dispute, claim, or matter arising out of or relating to these Terms or the use of the Platform shall be governed by and interpreted in accordance with the applicable laws set out below:

• (a)For Members located in India, these Terms shall be governed by the laws of India and will be subjected to the Courts in New Delhi; and
• (b)For Members located outside India, these Terms shall be governed by the laws of the State of New York.

Any dispute arising from these Terms or use of the Platform shall be resolved through confidential binding arbitration, except where applicable law permits otherwise or where injunctive relief is reasonably necessary to protect legal rights, confidential information, or intellectual property.

15. General Provisions

Members agree that the Platform's Terms & Conditions and Privacy Policy and Policy on Child Safety & Standards constitute the complete agreement between Members and the Platform regarding use of the Platform.

If any provision is found unenforceable, the remaining provisions shall continue in effect.

The Company shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, government actions, internet failures, cyber incidents, labor disruptions, or force majeure events.

Members agree to the Platform's Terms & Conditions and Privacy Policy and Policy on Child Safety & Standards and further agree that Members' electronic acceptance of these Terms including by creating an account, accessing the Platform, or using the Platform constitutes a legally binding agreement.

Provisions relating to confidentiality, payments due, intellectual property, dispute resolution, indemnification, limitation of liability and any other provisions that by their nature are intended to survive termination shall remain effective after termination or expiration of your membership or account.

16. Changes to Terms & Conditions (T&C)

We may change and/or update this T&C Policy periodically to reflect operational, technological, legal, regulatory, or service-related changes.

Updated versions will be posted on the Platform with a revised effective date. Continued use of the Platform following updates constitutes acceptance of the revised T&C Policy.

We encourage you to review our T&C, Privacy Policy and other Terms periodically to remain informed about how we collect, use, and protect your personal information.

By using The Classifieds, you acknowledge that you have read, understood, and agreed to the Platform's Terms & Conditions and Privacy Policy and Policy on Child Safety & Standards.
